So recently I just played Hitomi senpai and later I came and stumble across that the game was based of book . So that got me woundering if I can use some anime chacter for a game or is there rules for that ?

Since the vast majority of characters in games here are based on anime, game and cartoon characters... Not quite sure why you're asking? Just change the name to make it a parody and tweak it slightly and it should be fine.

Just making sure dont want to write a whole story and then make 1 change that makes me rewrite the script play the 2nd one was to make sure it was with the creators to see if I can make leagle loli lol
